Kartik heads the ADR practice at Panāyā Consulting. He is an independent arbitrator holding the Q.Arb designation with ADR Institute of Canada/ADRIO and the MCIArb designation with the Chartered Institute of Arbitrators (CIArb, UK).
Kartik has knowledge of both, unadministered (including UNCITRAL) and administered arbitrations, and accepts appointments as a commercial (domestic & international) dispute, business dispute, shareholder dispute, procurement dispute, real estate dispute, commercial lease dispute, construction dispute (not interim payments adjudication), franchise dispute, condo dispute, technology dispute, and reinsurance dispute arbitrator.
In addition, Kartik has completed over 50 hours of Mediator training through the International Mediation Institute (IMI) and occasionally volunteers at the Minnesota Mediation and Restorative Services (MARS) as a Mediator.
Kartik is also an award-winning financial expert, having worked and assisted as an expert on numerous international commercial arbitration matters, the seats of some which include SIAC, HKIAC, ICC and the LCIA.
He is an internationally trained Lawyer and Chartered Accountant (Fellow), Member of the Chartered Institute of Securities & Investments (MCSI, UK), and possesses the Certified Fraud Examiner (CFE) and Certified Valuation Analyst (CVA) designations.
Kartik is an empaneled Arbitrator on the rosters of FINRA (USA), World Intellectual Property Organization (WIPO, EU), National Futures Association (NFA, USA), and Thailand Arbitration Centre (THAC, Thailand), and appears in the Directory of Members of ADRIC, ADRIO, CIArb, and the Rising Arbitrators Initiative (RAI). Kartik has also been appointed as the sole arbitrator in arbitration(s) by the Ontario Superior Court of Justice (Canada).
Kartik’s ADR experience spans nearly two decades, during which he has advised legal counsels and CxOs in domestic and transnational matters relating to disputes advisory, fraud and international regulatory compliance. He has worked across several jurisdictions some of which include Southeast Asia, the Middle East, Europe and the Americas. Kartik’s industry experience is diverse, cutting across industries and sectors.
His ADR experience spans a broad range of business and legal subjects including oil & gas, infrastructure, real estate & construction, financial services, corporations and shareholders, industrial & consumer products, partnerships, joint ventures & other contractual arrangements.
Hi, my name is Kartik Gupta, and I am an International Mediation Institute (IMI) Qualified Mediator with nearly 150 hours of mediation-specific training from renowned international institutes such as IMI and ADRIC. I specialize in resolving commercial disputes (both domestic and international) such as contracts, partnerships, mergers and acquisitions, intellectual property, and international trade. I have also mediated complex and sensitive housing disputes, such as landlord-tenant, co-op, condo, and homeowners association issues, working with the Anoka County Housing Court and the 10th Judicial Housing Court. I also volunteer my time as a Mediator with the Mediation and Restorative Services (MARS, USA).
My philosophy of mediation is based on the principles of honesty, impartiality, and professionalism. I respect the parties’ rights, interests, and goals, and I treat them with dignity and courtesy. I ensure that the parties have an equal opportunity to participate in the mediation process and to make informed decisions. I also maintain the confidentiality of the mediation process and the information shared by the parties, unless they agree otherwise or the law requires disclosure.
My style of mediation is a mix of facilitative and evaluative, which means that I adapt my approach to suit the needs and preferences of the parties and the nature of the dispute. Sometimes, I help the parties communicate effectively, understand each other’s perspectives, and explore their options for reaching a mutually acceptable agreement. I do not impose my own opinions or solutions, but rather guide the parties through a structured and collaborative process that empowers them to make their own decisions. Other times, I provide the parties with an assessment of their case and the likely outcome if they go to court or arbitration. I also help the parties identify their strengths and weaknesses, and suggest possible solutions that are fair and realistic. I do not force the parties to accept any solution, but rather assist them in reaching their own agreement.
I have the skills and knowledge to help you resolve your dispute effectively and efficiently. I have a financial and accounting background, which allows me to assess the monetary implications of the conflict. I also have legal training and experience in various alternative dispute resolution methods, which gives me a comprehensive perspective on the legal and business issues at stake. Moreover, as a mediator, I have been trained to empathize with the parties and address the emotional and relational aspects that may influence the outcome.
